Man Mistakenly Acquitted by Hung Jury, but Killed Within an Hour

The Fresno Bee reported that Bobby Lee Pearson, 37. was acquitted after the jury deadlocked 8-4 on his guilt in a California burglary case. Because the verdict forms were not clear and contained no line for "deadlocked," the jurors mistakenly signed a not guilty verdict. When the Judge asked the jury if that was indeed their verdict on the charges against Pearson, all 12 nodded yes.

 

A juror later indicated to court staff that he had voted guilty, but it was too late to fix the error because of double jeopardy. The Defendant was released.

 

However, Pearson was not able to enjoy his freedom. Within an hour of his release he was fatally attacked by his sister's boyfriend. Police said Pearson went to his sister's home on Dayton Avenue to get property he said belonged to him. There was an argument, which spilled out onto the street. A steak knife was found by police next to the fatally-wounded Pearson.
